I admire your spunk. I say each violation of a total strangers space makes the next violation that much easier.

I would say that you should do what you said you would do -- send him the photo(s) in an e-mail. I would thank him for his approval to make the photos and the drawing and make reference to the time and place. Then keep your e-mail and his response on file. If you create some art from the photo then you could get back in touch with him with a copy of your drawing. You could at that point ask for further approval to include the drawing on your web site.

That's what I will do. Thanks Mike and Debra. Mike, this was the greatest little joint in Tequesta, Fla. The BEST pork ribs I have had in a long time. That and a Corona with a twist of lime and salted rim - that spells vacation!!

What a terrific subject! Given the photos you have, I wouldn't attempt a painting from any of them.

If I were in your position, I would probably just give him the images, and let him know that , while they are delightful photographs, they won't work for a painted portrait. Then arrange to get whatever resouce information you will need.

Patrica,
Make sure you have one of the parents sign a model's release form that says you can use the photographs for portraits or any other type of art. The book "Art Marketing 101" by Constance Smith gives all the legal reasons why this is necessary plus provides a sample release form to use.

I agree with the sentiments expressed above: Cute kid, not suitable portrait reference material (too much hair in the way, too casual, etc) and you need to get a model's release signed by the guardian on the spot to give you written permission (to photograph her, to put the photos on the Internet and to paint from the photos.) Nice step in the right direction, though.
